ANSES Sustainability Guarantee Fund: Key Aspects of Its Investment Portfolio and Profitability
The Sustainability Guarantee Fund (FGS) is one of the main financial instruments managed by ANSES to support the Argentine Integrated Pension System (SIPA). Created in 2007 and strengthened after the unification of the pension system in 2008, its goal is not only to preserve the value of its assets but also to generate returns that contribute to the sustainability of the pension system and meet certain obligations set by current legislation.
The fund constitutes a specific purpose asset. This means that its resources have a destination determined by law and can only be used in the cases established by the regulations. In addition to seeking financial profitability, the FGS also directs part of its investments towards projects that boost economic activity and the Argentine capital market.
The FGS portfolio consists of a wide variety of financial assets. These include national public securities, shares of corporations, fixed-term deposits, negotiable obligations, mutual funds, financial trusts, mortgage bonds, loans to provinces, and credits aimed at beneficiaries of SIPA itself. This diversification seeks to reduce risks and preserve the value of the assets managed by ANSES.
Current legislation establishes which instruments the fund can invest in and also sets limits and prohibitions for certain operations. Thus, the administration must respect the criteria set forth by Law 24.241 and its amendments when forming the investment portfolio.
In addition to maintaining traditional financial investments, the FGS holds equity stakes in various private companies, largely inherited from the process of incorporating assets managed by the former AFJPs into the public system. It can also participate in trusts aimed at financing infrastructure works and productive projects deemed strategic for the national economy.
ANSES maintains that the management of the FGS is not solely based on maximizing financial returns. According to the agency, investment decisions simultaneously consider criteria of safety, profitability, and public interest, prioritizing those projects that can generate employment, increase economic activity, and strengthen the future resources of the pension system.
This concept is known as the "virtuous circle". Increased investment in infrastructure and production can translate into more registered employment. This increase in formal work raises the contributions that finance SIPA, strengthening the sustainability of the pension system.
Therefore, the agency clarifies that the FGS does not exclusively pursue the highest possible profitability but seeks to balance financial results with the economic and social impact of investments.
The regulations establish that the FGS can financially assist ANSES when there are insufficiencies in the financing of the public pension system that may affect the payment of benefits. However, this use is not automatic.
When the agency considers it necessary to resort to the fund, it must inform the Cabinet Chief whether the projected deficit responds to a temporary situation or, on the contrary, is due to structural problems that require modifications in the functioning of the pension system.
This mechanism seeks to ensure that the FGS's assets maintain their long-term backup function and are not used as a permanent source of financing.
Another of the functions expressly provided by legislation is the possibility of using resources from the Sustainability Guarantee Fund to meet commitments arising from the Law 27.260 on Historical Reparation for Retirees and Pensioners.
The regulations authorized that payments related to this program could be made with resources from the FGS. If those funds were insufficient, the legislation also provides for the possibility of disposing of assets from the fund's patrimony, respecting the control mechanisms established by law.
The management of the FGS is under the jurisdiction of ANSES and has the assistance of an Executive Committee. Its operations are subject to the control of various agencies, including the FGS Council, the Bicameral Commission for the Control of Social Security Funds, the General Audit Office of the Nation, and the Ombudsman of the People.
