A federal judge in the Southern District of New York, Andrew Carter, has ruled to pause the civil case brought by the U.S. Commodity Futures Trading Commission (CFTC) against U.S. Army Special Forces Sergeant First Class Gannon Ken Van Dyke, pending the outcome of related criminal proceedings. The prosecution filed a motion to pause in July. Gannon Ken Van Dyke is accused of using non-public information to profit over $400,000 from event contracts related to the ousting of Venezuelan President Nicolás Maduro on Polymarket. The U.S. Department of Justice stated that he participated in the operation to overthrow Maduro in January of this year. Both criminal and civil cases were filed in April. Van Dyke has pleaded not guilty to all charges and has requested the dismissal of the criminal prosecution, with the case potentially set to go to trial as early as late 2026 or early 2027.
